          4                 MR. BIARD:  Good morning.  My name is Bob

          5   Biard.  I'm the General Counsel of the Texas Lottery

          6   Commission.  The time is 11:03 a.m., on December 5,

          7   2012.  And this is a hearing to receive public comments

          8   regarding the proposed amendments to 16 Texas

          9   Administrative Code §401.305 relating to Lotto Texas

         10   on-line rule.

         11                 The proposed amendments and notice of this

         12   hearing was published in the November 23, 2012, issue of

         13   the Texas Register at 37 Texas Register, Pages 9227 and

         14   9404, and on the Texas Lottery Commission's website.

         15   The Commission voted to propose these amendments at a

         16   public meeting on November 8, 2012.

         17                 With me today on my left is Robert

         18   Tirloni, Products Manager from the Commission's Lottery

         19   Operations Division.

         20                 I look around.  I note that there are no

         21   persons from the public in attendance, no persons in

         22   attendance here, other than staff at the Texas Lottery

         23   Commission.  So I think I would like to recess this

         24   hearing for 15 minutes to give any late arrivals an

         25   opportunity to appear.  And we well reconvene at 11:20.

          1   And if there are any commenters here, we'll receive

          2   public comment at this time; and, if not, we will

          3   adjourn.  So we'll go on a break right now at 11:05.

          5                 MR. BIARD:  Okay.  It is 11:20, and we're

          6   back on the record, 11:20 a.m., on December 5th.  And no

          7   one has appeared to give comment on the proposed rule

          8   amendments.

          9                 These amendments to Section 401.305 are

         10   for the purpose of adding a new add-on game feature

         11   called "Extra" that allows players to purchase a chance

         12   to increase the amount of any non-jackpot prizes won in

         13   a Lotto Texas drawing and to win a prize for matching

         14   two of the six numbers drawn, to increase the length of

         15   the annuitized prize payment period from 25 years to 30

         16   years, and to make certain clarifications to the rule

         17   language.

         18                 We will continue to have an open comment

         19   period and to receive comments through December 23rd.  I

         20   think that may be a Sunday.  If that's the case, then

         21   we'll receive comments through the 24th, Monday.
